Welcome to BattleItOut. These terms are the agreement between you and T-Invent, LLC, doing business as BattleItOut (“we”, “us”). By creating an account you agree to them.
1. Who can use BattleItOut
You must be 18 or older to create an account.
People under 18 can take part in battles, but they do not get their own account. An adult participates on their behalf and is responsible for everything posted under that account — including photos of a minor.
If we learn an account belongs to someone under 18, we will close it.
2. What BattleItOut is
BattleItOut is a tool for setting a challenge with people you know, tracking it, and recording who followed through.
What we are not:
- We are not a party to any stake. When you agree that the loser buys dinner, that agreement is between you and the other participants. We are not part of it.
- We do not handle money. No payments pass through BattleItOut between users. We hold no funds, transfer nothing, and take no cut of anything.
- We do not enforce stakes. If someone loses and never buys the dinner, we cannot make them. We record the result. The rest is between you.
- We are not a gambling service. Battles are decided by what participants do, not by chance, and nothing of value is staked with or paid through us.
Please only agree to stakes you can genuinely afford and intend to honour.
3. Your account
You are responsible for what happens under your account and for keeping access to your email or phone secure.
Provide accurate information. Don’t impersonate anyone or create an account for someone else without their knowledge.
You can close your account at any time from settings.
4. Battles and stakes
Rules lock when someone accepts. Once a participant accepts, the battle’s name, dates, targets and stake tier cannot be changed. This protects everyone from terms shifting after they committed.
Stakes must not involve:
- Anything illegal
- Consuming alcohol or drugs
- Speed-eating or any eating or drinking contest
- Sexual content, or anything involving a minor
- Self-harm, physical harm, or harm to an animal
- Weapons
- Harassment, humiliation, or degrading treatment
- Anything requiring someone to break a law, a workplace policy, or a duty they owe someone else
The product blocks the legal floor at the point of writing — illegal, sexual, involving a minor, self-harm. Everything else on this list is a prohibited use enforced by reporting and account action rather than by an automated filter.
In workplace battles, stakes must not single out an individual as a loser, and must not require someone to provide anything of value to a manager or anyone senior to them.
We can remove any battle or stake that breaks these rules, without notice.
5. Proof, photos and your content
To close a battle you may need to submit photos or video.
By posting, you confirm: the content is yours or you have permission to post it; everyone identifiable in it has agreed to appear; and it does not break these rules.
Who can see it: content you post in a battle is visible to the other participants in that battle. If you choose to share something outside the app, that’s on you.
What we can do with it: you keep ownership. You give us permission to store and display your content inside the app so the product works. We claim no marketing rights over your content.
Photos of children: if you post a photo showing a minor, you confirm you are their parent or guardian, or have that person’s permission.
Video follows the same rules as photos, and is limited to 60 seconds.
We can remove content that breaks these rules or that we’re required to remove.
5a. Judged battles
Some battles are decided by judges rather than by a number.
The criteria and the judges are set before anyone enters and cannot be changed afterwards. You can see both before you decide whether to take part.
Judges do not compete in a battle they judge.
Entries stay hidden until the deadline, so nobody gains an advantage by going last. You can replace your entry up to that point.
Once every judge has scored, the result is final. Judging is a matter of opinion. We will not re-score a battle because you disagree with the outcome, and neither will the judges.
5b. Routines and testimonials
You may share what you’re doing — your plan, your schedule, how you eat — and write about how a battle went.
This is not advice and we do not check it. Anything another participant shares is their own experience, not a recommendation, and not reviewed by us or by anyone qualified. Talk to a doctor before changing what you eat or how you train.
We do not collect structured health data. There are no nutrition fields, calorie targets or macro tracking anywhere in BattleItOut, by design.
5c. Polls and group decisions
Where a group votes on what to do, the option with the most votes becomes the battle. The result of a vote is final, and votes cannot be changed once a poll closes.
Being outvoted doesn’t commit you to anything. You still choose whether to accept the battle that follows.
6. Results and disputes
Different battles close differently. Where everyone competes against their own target, each participant reports their own result. Where there’s a single winner, results are posted and participants have a window to flag a problem.
If participants disagree, we may make a final decision, and that decision is final. We are not a court. We look at what was submitted and make a practical call so the battle can close.
We do not arbitrate the stake itself. Whether the dinner was bought, and whether it was a good dinner, is not something we resolve.
Draws. Where participants agree a draw, neither stake is performed and the battle is recorded as a draw.
Placing. Some battles recognise more than one finishing position. Anyone inside the recognised places does not perform a stake. The creator sets how many places count before anyone enters.
Witnesses. A witness watches a solo battle without competing. They receive notifications about it. They cannot submit a result, cannot change one, and their view carries no weight in any dispute.
7. Behaviour
Don’t use BattleItOut to harass, threaten, bully, or humiliate anyone. Don’t post content that is hateful, sexual, violent, or otherwise inappropriate.
Don’t cheat — no faked photos, no reused images, no false results.
Don’t try to break, scrape, overload, or reverse-engineer the service.
You can report content or block another user at any time.
8. Suspending or closing accounts
We can suspend or close an account that breaks these terms. Where it’s reasonable to do so, we’ll tell you why.
Serious breaches — anything involving a minor, threats, or illegal activity — result in immediate removal and may be reported to authorities.
8a. Brand campaigns
Some challenges are run by a company, free to enter, with prizes they fund.
Joining is free and never requires you to give anyone rights to your photos.
Photo permission is asked for one photo at a time, at the moment you post it, and is switched off unless you turn it on. Before you turn it on you’ll see exactly where the photo could appear, for how long, and whether it can be edited. We record the wording you agreed to, so it can be shown later.
You can take permission back at any time from settings. We remove the photo from the company’s library straight away. We cannot recall anything already printed or published before you withdrew permission.
If other people appear in a photo, you confirm they agreed to it before you grant permission.
No photo showing anyone under 18 may be licensed, with or without permission.
The company never receives your email address or phone number through us. If you choose to hear from them, that’s a separate choice and it doesn’t come bundled with photo permission.
9. Paid features
Subscriptions renew automatically until cancelled. Cancel any time; access continues to the end of the period you’ve paid for.
Payments are processed by Stripe, and are subject to Stripe’s own terms.
Prices can change with notice before your next renewal.
We never charge you for losing a battle, and we never take a share of anything staked between users.

How we handle your information is covered in our Privacy Policy.
11. The service itself
We provide BattleItOut as it is. We try to keep it working and accurate, but we can’t promise it will always be available or error-free.
We can change or discontinue features. If we shut the service down, we’ll give reasonable notice and a way to get your data.
12. Limits on our responsibility
BattleItOut is a tracking tool. We are not responsible for what participants agree to do, whether they do it, or what happens while they do it. Take care of yourself, and talk to a doctor before starting anything physically demanding.
13. Changes to these terms
We may update these terms. If a change is significant we’ll tell you before it takes effect. Continuing to use BattleItOut after that means you accept the updated terms.
